Seller Terms

SALES SERVICE
Emmy Clothing Company Oy (Business ID 2693438-9) (“Emmy”) sells pre-owned items to adult private individuals. Pre-owned items are sold on a consignment basis where the owner of the item (the “Seller”) is another private individual, but the purchaser (the “Buyer”) enters into the purchase with Emmy.
By sending items to Emmy for sale, the Seller accepts these Terms of Sale. Emmy sorts, photographs, prices, and stores the items for the duration of the sale. Emmy handles delivery of purchased items to the Buyer, any returns processing, payment collection, customer service, and remittance of sales proceeds to the Seller.
For sales of used goods, we apply the margin scheme as defined in the Finnish VAT Act (AVL 79 a §). Consequently, VAT on used items is 0%. VAT of 25.5% applies to any other products, items sold by business sellers, and to shipping charges.
We reserve the right to amend these terms, including pricing, sales periods, and sales proceeds shares.
SENDING ITEMS FOR SALE
Emmy accepts for sale pre-owned branded clothing, shoes, accessories, sunglasses, and bags for women, men, and children, as well as outdoor/trekking products, from Finland and Estonia. Items must be saleable (intact, clean, odour-free, current, with brand label intact). Check brand eligibility here.
Items can be delivered to Emmy in several ways:
- Order an Emmy Home Pickup
- Drop off at Emmy public drop-off boxes and partner collection points
- Posti parcel to a locker or service point
- Matkahuolto parcel via locker or service point
- Bring in person to Emmy’s location (Hemmolankatu 19, 08150 Lohja)
Items must be packed in sturdy packaging and sealed so they cannot open in transit. For Posti: max parcel size 100 × 60 × 60 cm and 35 kg. For Matkahuolto: max 70 × 50 × 47 cm. For Emmy Home Pickup: one box max 80 × 60 × 50 cm, max 20 kg. Each parcel delivered by any of the above methods constitutes one consignment. The Seller may send multiple consignments at once.
For Emmy drop-off boxes, items may also be packed in reusable shoppers or durable plastic bags. The drop slot accepts packages up to approx. 60 × 30 cm. One consignment may include multiple packages when using drop-off boxes.
Before shipping, the Seller must complete Emmy’s online seller form. Each parcel must be clearly labelled with the EMMY identifier provided in the form. Selections made on the seller form apply to all packages in that consignment, except the payout method. The chosen payout method applies to all consignments currently for sale for that Seller (only one payout method can be active at a time).
The Seller is responsible for the accuracy of the information provided and for ensuring that no third-party rights are infringed. The Seller is always responsible for having the right to sell and send the items provided to Emmy for sale.
Emmy is not liable for consignments lacking an EMMY identifier or that are inadequately packed.
Leaving items in Emmy drop-off boxes is at the Seller’s own risk. Emmy is responsible for handling and storage after the items have been received at Emmy’s facility. Drop-off boxes are lockable and placed, whenever possible, indoors under camera or other supervision, in locations with people present during opening hours. The boxes are designed to prevent pilferage.
Emmy’s liability for damages is limited in all cases to direct damages and to a maximum of 50% of the item’s fair market sale value.
SALES PERIOD
Emmy undertakes to sell items for 6 months (the “Sales Period”). By accepting these terms, the Seller authorizes Emmy to sell the items for this 6-month period.
SALES CHANNELS
Items are sold primarily through Emmy’s online stores. Within the Sales Period, Emmy may also list items on other channels, such as online auctions, marketplaces, partner webshops, or classified sites. Emmy may also sell items directly from its warehouse, at events, and at its own or partners’ physical sales points.
ITEM ASSESSMENT & LISTING FOR SALE
Emmy evaluates each item’s condition and saleability and decides whether to list it. Saleability is determined according to the current garment and packing guidelines and Emmy’s own discretion on what items have a reasonable chance of selling. As a rule, items must be among Emmy’s accepted brands, intact, clean, odour-free, and current to be accepted for sale. Emmy does not accept furs, underwear, jewellery, watches, or toys. Even a small hole, ripped seam, or similar defect will generally result in rejection. Any pest suspicion will always result in rejection of the entire consignment. Stains, heavy wear, and out-of-date styles are also common reasons for rejection.
Emmy may decide not to list any given item. If, on the seller form, the Seller has not chosen to have unsaleable items returned, those items pass to Emmy’s ownership without compensation. Emmy will forward such items for further processing. Items that are wearable but not a fit for Emmy’s selection may be sent to a domestic partner for onward sale or to charity. Items not suitable for sale are forwarded as textile waste for processing. In such cases, the Seller can no longer reclaim the items. If the Seller requested return of unsaleable items, they will be returned immediately after handling and assessment. A Return Fee applies; see “Returning Items Back to the Seller”.
Emmy will notify the Seller for each consignment when the items go live. We recommend the Seller checks the product information on the seller portal and promptly reports any errors or omissions to customer service (info@emmy.fi).
PRICING
Emmy sets the listing price it deems to reflect the market price at which the item will sell at that time. Prices decrease over time via automatic markdowns. Emmy may change item prices at any time and run promotional discounts that affect the final sale price.
UNSOLD ITEMS
Items that do not sell within the Sales Period transfer to Emmy’s ownership after the period ends, unless the Seller redeems the desired items back via the seller portal within the specified time. Redemption is subject to a fee; see “Returning Items Back to the Seller”. If the Seller does not redeem the items, Emmy has the right to sell them through its own or domestic partners’ channels. The Seller will be credited €1 per unsold item forwarded for onward sale.
RETURNING ITEMS BACK TO THE SELLER
Unsaleable items:
On the seller form, the Seller can choose to have unsaleable items returned. If selected, such items are returned immediately after handling and assessment. A Return Fee of €15.90 applies.
The Return Fee is not invoiced separately; it is deducted from the Seller’s sales proceeds. It is always deducted from the first payable sales proceeds and cannot be changed thereafter.
The sales account balance may become negative due to fees. Negative balances are not collected from the Seller; however, when sending the next consignment, the sales proceeds calculation will first offset any negative opening balance.
Unsold items:
After the 6-month Sales Period, the Seller is notified by email if any items remain unsold. The Seller may then redeem desired unsold items via the seller portal for a Service Fee of €12.90. In addition, if items are shipped back, the current shipping fee per Emmy’s price list and the chosen delivery method will be charged. Items may also be collected from Emmy’s facility to avoid shipping fees. Redemption must be completed within 2 weeks of the notice. After that, the items transfer to Emmy’s ownership without compensation.
SELLER’S PROCEEDS
From each item’s final sale price, Emmy pays the Seller a sales share (the “Sales Proceeds”) and retains the remainder as commission. Proceeds are calculated per item according to the then-current proceeds table. Any Emmy promotions or discounts affect the final sale price and therefore the Sales Proceeds.
The Seller may choose to receive Sales Proceeds as cash or as gift cards for Emmy or Emmy’s partners. The Seller may also donate proceeds to Emmy’s charity partners, or leave them unclaimed, in which case Emmy uses them to develop its service.
Emmy remits Sales Proceeds only after full payment has been received from the Buyer. Proceeds are paid and gift cards issued once per month, at the end of the month following the sale month. This ensures the Buyer has sufficient time to receive the items and exercise the statutory 14-day right of return.
If monthly Sales Proceeds are under €10, they are carried over to the next month’s payout. All unpaid proceeds are paid out no later than after the Sales Period ends, on the last day of the following month. The minimum for final payouts is €1. Smaller amounts are not paid out or issued as gift cards.
HANDLING & SHIPPING FEES
From the first Sales Proceeds of items supplied by the Seller, Emmy deducts €6.90 in handling and shipping fees per consignment left in an Emmy drop-off box or partner store, and €6.90 per parcel when sent via Posti, Matkahuolto, or Emmy Home Pickup (the “Shipping Fee”). If the Seller brings items directly to Emmy’s facility, no Shipping Fee is deducted. Both the Shipping Fee and any Return Fee are deducted before transferring proceeds to the Seller’s bank account or converting to a gift card.
A publishing fee is charged for all items listed: €1 per published adult item and €0.50 per published children’s item. Handling and publishing fees are deducted from Sales Proceeds. If proceeds are less than the fees, the sales proceeds are €0. The Seller never has to pay a negative balance to Emmy.
Emmy also has the right to charge the Seller reasonable additional costs caused by disregarding the provided instructions when submitting items for sale (e.g., a large quantity of unsaleable items).
LIMITATION OF LIABILITY & FORCE MAJEURE
Emmy is not liable for delays or damages caused by circumstances beyond its reasonable control that it could not have foreseen or avoided. Force majeure includes, for example, labour actions, staff illness, fires, natural disasters, import/export bans, and transport disruptions.
Operation of the online store may be interrupted for reasons beyond Emmy’s control. Emmy cannot guarantee continuous, uninterrupted, or secure access to and use of the online store. The online store is provided “as is,” “as available,” and with all faults.”
MISCELLANEOUS
In the event of non-payment, Emmy or its partner will initiate a collection process and cover any resulting costs. In the case of a credit loss, no Sales Proceeds will be paid for the affected item.
Any disputes may be brought by the Seller before the Finnish Consumer Disputes Board. If a dispute proceeds to court, it will be heard in the District Court of Helsinki.
